The reason the judge is the deciding factor in the case is because the question is “Is this person a menace to society or not?” That is the question that the court is asked to decide. The defendant in this case was the one who was the threat to society.
And the reason why a single person is a better legal decision maker is because the prosecution won’t have the benefit of a full trial, only the one on the day of the trial. So they will only have a chance to present their case and argue their case. This means that the judge will have to decide what they are saying to the jury. This will likely cause a bit of a problem because the judge will give the jury the impression that he has no idea what they are asking.
So why don’t people have to wait until the last minute to make a decision? Because judges are human and most people don’t want to wait and so they will give the jury the impression that they have no idea what they are asking.
